Terms of Service

By accessing or using BookMyNails.ca ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Platform.

BookMyNails ("we", "us", "our") provides a SaaS booking and salon management platform designed for Canadian nail salons, spas, and beauty businesses.

BookMyNails serves two types of users:

• Salon Owners ("Business Users") — Businesses that register on BookMyNails to manage their salon, accept bookings, and use our SaaS tools. Sections 4–8 apply specifically to Salon Owners.
• Customers ("End Users") — Individuals who create an account to book appointments, earn loyalty points, manage gift cards, and track their booking history. Section 3A applies specifically to Customers.

All other sections apply to both user types unless stated otherwise.

To use BookMyNails, you must be at least 18 years old and legally capable of entering into binding agreements. By creating an account, you represent that you meet these requirements.

Customers may create a free account on BookMyNails to access the following features:

• Booking Management: View, reschedule, and cancel appointments across all salons
• Loyalty Points: Earn points from completed bookings at participating salons. Points are salon-specific and have no cash value
• Gift Cards: View balances and redemption history for gift cards received from participating salons
• Coupons & Promotions: Access available discounts from salons you've visited
• Reviews: View and manage reviews you've submitted
• Favourite Salons: Save salons for quick rebooking

BookMyNails uses SMS-based verification to protect accounts and prevent spam:

• Salon Owner Login: After entering your email and password, a one-time verification code (OTP) will be sent via SMS to your registered personal mobile number
• Customer Bookings: Customers must verify their phone number via SMS before completing a booking
• Verification codes expire after 5 minutes and can only be used once
• SMS messages are sent via Twilio
• Standard message and data rates from your mobile carrier may apply
• By providing your phone number, you consent to receiving SMS verification messages from BookMyNails

When booking an appointment through BookMyNails, customers are asked to provide a phone number and consent to receiving SMS messages:

• Booking Confirmations: You will receive an SMS confirming your appointment details after booking
• Booking Reminders: You may receive SMS reminders before your scheduled appointment
• Booking Updates: You may receive SMS notifications if your appointment is rescheduled or cancelled by the salon
• You can opt out at any time by replying "STOP" to any message
• Standard message and data rates from your mobile carrier may apply

BookMyNails offers a 30-day free trial for new salon accounts. During the trial:

• You have full access to the platform features
• No credit card is required to start
• Up to 4 staff members are included
• Your trial begins on the date of account creation

After the trial period, you must subscribe to a paid plan to continue using the platform. Your data will be preserved for 30 days after trial expiration, after which it may be deleted.

Subscriptions are billed monthly. Payments are processed securely by Stripe. By subscribing, you authorize us to charge your payment method on a recurring monthly basis. All fees are non-refundable except as required by applicable law.

You may cancel your subscription at any time from your dashboard settings. Cancellation takes effect at the end of the current billing period. You will retain access to the platform until the end of the period you have paid for.

All content, features, and functionality of the BookMyNails platform, including but not limited to the software, design, text, graphics, and logos, are the exclusive property of BookMyNails and are protected by Canadian and international intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the platform.

You agree not to use the platform to:

• Post false, misleading, or fraudulent information
• Harass, abuse, or harm other users
• Violate any applicable laws or regulations
• Attempt to gain unauthorized access to any part of the platform
• Use automated tools to scrape or extract data without written permission
• Impersonate any person or entity

BookMyNails provides the platform "as is" without warranties of any kind. To the maximum extent permitted by applicable law, BookMyNails shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform. Our total liability shall not exceed the amount you paid us in the past 12 months.

You agree to indemnify and hold harmless BookMyNails, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the platform or your violation of these Terms.

Your use of the platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

We reserve the right to modify these Terms at any time. We will notify you of significant changes by email or through a notice on the platform at least 14 days before the changes take effect. Your continued use of BookMyNails after the updated Terms take effect constitutes your acceptance of the changes.

We reserve the right to suspend or terminate your account at any time if you violate these Terms, engage in fraudulent activity, or for any other reason at our sole discretion.

In the event of a dispute, you agree to first attempt to resolve the matter informally by contacting us at support@bookmynails.ca. We will make reasonable efforts to resolve the issue within 30 days. If informal resolution is unsuccessful, both parties agree to submit the dispute to binding arbitration in accordance with the rules of the Canadian Arbitration Association, conducted in Ontario, Canada.

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.
